LiftCue Terms of Service
Version 1 — Effective date: September 23, 2026
These terms are an agreement between you and Nick Onofrio ("we", "us"), the operator of the LiftCue iOS app ("the app"). Please read them: by creating an account or using the app you agree to them and to our Privacy Policy. If you don't agree, don't use the app.
1. Who can use LiftCue
- You must be at least 17 years old.
- If you are under 18, a parent or legal guardian has read these terms and agrees to them on your behalf, and is responsible for your use of the app.
- The app is not for anyone under 13, and we do not knowingly let anyone under 13 use it.
2. What LiftCue is — and isn't
LiftCue lets you film a set, sends the video to Google's Gemini model under your own API key, and shows you the automated feedback it returns. It also lets you log workouts and runs, and share your progress with friends.
LiftCue is not a medical service, a health service, or a professional coaching service. No person reviews your lifts. The feedback is generated automatically and is offered as general information about lifting technique, nothing more.
3. Health and safety — please read this
Exercise, and lifting weights in particular, carries a real risk of injury, including serious injury. You are responsible for your own safety.
- AI feedback can be wrong. It may be inaccurate, incomplete, out of date, or miss the thing that matters most in your set. Do not rely on it as the only check on your form.
- You decide what to lift and how. Use weights you can control. Warm up. Stop if something hurts or feels wrong.
- Talk to a physician before starting a new exercise program, especially if you have a medical condition, are pregnant, or are recovering from an injury.
- In an emergency, contact your local emergency services. The app cannot help you in an emergency.
- Scores, streaks, badges, leaderboards, records and comparisons with friends are for motivation. They are never a reason to lift more than you safely can.
By using the app you accept these risks. To the fullest extent the law allows, you agree that we are not responsible for any injury, illness or loss that results from your training, whether or not you followed the app's feedback.
4. Your API key
The Gemini API key you enter is yours. It stays on your device and we never receive it. Your use of Gemini is governed by Google's API Terms and the Gemini API Additional Terms. You are responsible for keeping your key private and for anything Google bills you for its use.
5. Your account
You don't need an account to analyze lifts. If you create one:
- give us accurate information and keep it accurate;
- keep your sign-in details private — you are responsible for everything done with your account;
- create one account per person, and don't share it.
6. Your content
"Your content" means the videos, thumbnails, captions, comments, reactions, workout and run details, and anything else you post or share through the app.
- You own your content. We claim no ownership of it.
- You give us a license to store, copy, process, transmit and display your content, worldwide and without charge, only as needed to run the app and show your content to the people you choose to share it with. This license ends when you delete the content or your account, except for copies that remain for a limited time in backups.
- You promise that:
- your videos are your own lifting videos;
- anyone visible in your video is OK with it being shared;
- you have the rights needed to post your content, and it doesn't break any law or anyone else's rights.
- We can remove content at our discretion, with or without notice, if we believe it breaks these terms or creates a risk for us or for other users. We have no obligation to monitor content, though we may.
7. Community rules
The community rules shown in the app before your first social action are part of these terms. Today they are:
- Be respectful — no harassment, hate, or bullying.
- Post only your own lifting videos.
- No objectionable or abusive content. Zero tolerance: violations get content removed and accounts banned.
- Use Report (⋯ on any post or comment) to flag problems; use Block to stop seeing someone.
- Anyone visible in your video is OK with it being shared.
- Comments are opinions, not coaching — nobody here is responsible for your lifts.
8. Things you must not do
- Harass, threaten, bully or demean anyone, or post hateful content.
- Impersonate anyone, or misrepresent who you are.
- Post content that isn't yours, or that shows someone who hasn't agreed to be shown.
- Post anything illegal, or use the app for anything illegal.
- Get around a block, a ban or any other restriction.
- Scrape, crawl or access the app or its data by any automated means, or probe or interfere with its servers.
- Copy, modify, reverse engineer or resell the app.
9. Reports, moderation and enforcement
Every post, comment, profile and compare card can be reported from the app, and you can block anyone. We review reports and may remove content, suspend or terminate accounts, and take any other action we consider appropriate, with or without notice.
If you believe content in the app infringes your copyright, email us (see "Contact") with: a description of the work, where the content appears in the app, your contact details, a statement that you believe in good faith the use is not authorized, and a statement, under penalty of perjury, that you are the owner or authorized to act for the owner. We remove infringing content and terminate repeat infringers.
10. Privacy
Our Privacy Policy explains what data the app handles, who can see it, and how to delete it. It is part of these terms.
11. Third-party services
The app relies on services run by other companies — Google (Gemini and Sign in with Google), Apple (the App Store, Sign in with Apple and push delivery), Supabase, Expo, Sentry and Resend. Their terms apply to their services. We are not responsible for those services, for their availability, or for what they do with data you send them directly (for example, videos you send to Gemini).
12. Our intellectual property
The app, the LiftCue name and logo, the demonstration clips and everything else we made are ours or our licensors'. We give you a personal, non-exclusive, non-transferable, revocable license to install and use the app on an Apple device you own or control, under these terms and the App Store's rules. That's the only right you get.
13. Feedback you send us
If you send suggestions or feedback, we may use them without any obligation to you.
14. No warranties
The app is provided "as is" and "as available". To the fullest extent the law allows, we make no promises about it — including that it will be accurate, reliable, available, error-free or safe, or that AI feedback will be correct or suitable for you. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
15. Limitation of liability
To the fullest extent the law allows:
- we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from the app or these terms, however caused;
- we are not liable for personal injury arising from your exercise or training;
- our total liability for all claims arising from the app or these terms is limited to the greater of fifty US dollars ($50) and the amount you paid us in the twelve months before the claim.
Some places do not allow some of these limits. Where that is the case, the limits apply as far as the law there permits.
16. Indemnification
You agree to defend and indemnify us against claims, losses and expenses (including reasonable legal fees) arising from your content, your use of the app, or your breach of these terms.
17. Ending things
You can stop using the app at any time, and delete your account in the app (Settings → Manage account → Delete account). We may suspend or terminate your access at any time if we believe you have broken these terms or if we stop offering the app. Sections 3, 6 (the license, for backup copies), 12, 14, 15, 16 and 20 survive termination.
18. Apple
Because the app is distributed through Apple's App Store, these additional terms apply and take precedence over anything in these terms that conflicts with them:
- These terms are between you and us only, not Apple. Apple is not responsible for the app or its content.
- Your license to the app is limited to use on Apple-branded products you own or control, as permitted by the App Store's usage rules.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to any warranty, you may notify Apple and Apple will refund the purchase price (if any). Apple has no other warranty obligation.
- We, not Apple, are responsible for addressing any claim relating to the app, including product-liability claims, claims that the app fails to conform to a legal or regulatory requirement, and consumer-protection or similar claims.
- We, not Apple, are responsible for the investigation, defense, settlement and discharge of any claim that the app infringes a third party's intellectual property rights.
- You represent that you are not located in a country subject to a US government embargo or designated a "terrorist supporting" country, and that you are not on any US government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
19. Changes to these terms
We may change these terms. A change that matters gets a new version number and effective date at the top of this page, and the app will ask you to accept the new version before you continue using your account. Continuing to use the app after that is your agreement to the new terms.
20. Governing law and disputes
These terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to its conflict-of-laws rules. Before either of us starts a legal claim, we agree to try to resolve the dispute informally: email us, and we will try to work it out with you within 30 days. If we can't, any claim must be brought in the state or federal courts located in Virginia, and you consent to their jurisdiction. Nothing here limits any rights you have as a consumer under the laws where you live that cannot be waived.
21. General
These terms and the Privacy Policy are the whole agreement between you and us about the app. If any part is found unenforceable, the rest still applies. Our not enforcing a term is not a waiver of it. You may not transfer these terms; we may transfer them to a successor operator of the app.
